How the authority returns your documents?

If you are inside the United Kingdom, your documents will be returned to you by post to the address you provide on your application. If a representative makes an application on your behalf your documents will be returned to him or her. Your documents will be returned using recorded delivery. If you want your documents to be returned by special delivery, you should provide a prepaid special delivery envelope. You can also arrange for your documents to be collected by courier at your own cost. If you would like to arrange a courier, put a courier request in writing by fax to 0114 207 6555.

If you are outside the United Kingdom, your documents will be returned in the same way you sent them to the authority. For example, if you took them to a visa application centre, the visa application centre will return them to you.

Dependants

This section explains what documentary proof dependants (spouses or civil partners, migrant's unmarried or same sex partner or migrant's child) must provide of their available maintenance (funds) to support an application for leave to remain as the dependant of someone who is here under the entrepreneur category (Tier 1 Entrepreneur) of the points-based system to work in business in the United Kingdom.

The evidence provided can relate specifically to the dependant or it can also include evidence for the main applicant which has not been used as evidence of funds on the main applicant's own application or that of other dependants.

Dependants must send one or a combination of the following:

Transitional arrangements for maintenance

Normally, when applying from inside the United Kingdom, if the main applicant under the entrepreneur category is outside the United Kingdom or has been in the United Kingdom for less than 12 months, the family member must show that the main applicant or the dependant has at least £1,600 to support the dependant as well as the funds needed to support the main applicant.

If the main applicant has been present in the United Kingdom for 12 months or more, the main applicant or the family member of the entrepreneur must have £533 to support himself/herself.

Because this is a new requirement and it may be difficult to prove this immediately, we have put transitional arrangements in place for you and your family members submitting your applications within the United Kingdom up to and including 31 October 2008.

Up to 31 October 2008, you do not have to show you have had the funds for at least three months before your application. You must only show you have the required funds at the time you apply. Until 31 October 2008, your supporting evidence does not need to cover the three-month period, but the documents must be dated no more than a month before your application.

For example, if you apply under the highly skilled worker category on 12 July, a single bank statement with a closing balance of £800 dated between 12 June and 12 July will meet the maintenance requirements. A bank statement dated before 12 June will not be acceptable.

For applications submitted within the United Kingdom on or after 1 November 2008, and for applications submitted in countries overseas, you will have to meet the requirements below.
 

Personal bank or building society statements covering the previous three-month period

The personal bank or building society statements should clearly show:

  • The name of the main applicant and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom;
  • The account number;
  • The date of the statement;
  • The financial institution's name and logo;
  • Transactions covering the three-month period;
  • That there are sufficient funds have been present in the account for the past three months

If you wish to send electronic bank statements from an online account these must contain all of the details listed above. You must also send a supporting letter from your bank, on company headed paper, confirming the authenticity of the statements provided.


The authority will not accept statements which simply show the balance in the account on a particular day as these documents do not show that you hold enough funds for the full period required.

Building society passbook

The building society passbook should clearly show:

  • The name of the main applicant and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom;
  • The account number;
  • The financial institution's name and logo;
  • Transactions covering the three-month period;
  • That there are enough funds present in the account on a regular basis, and they are at least the amount needed; and
  • The regular receipt of funds along with regular withdrawals from the account.

Letter from bank confirming funds and that they have been in bank for at least the previous three months

The letter from a bank or building society should state:

  • Your name and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom;
  • The account number;
  • The date of the letter;
  • The financial institution's name and logo;
  • The funds held in your account; and
  • That the funds have been in bank for at least three months and are at least the amount needed.

Letter from a financial institution regulated by the Financial Services Authority confirming funds

The letter from a financial institution regulated by the Financial Services Authority should state:

  • The name of the main applicant and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom;
  • The account number;
  • The date of the letter;
  • The financial institution's name and logo;
  • The funds held in your account; and
  • That the funds have been in bank for at least three months and are at least the amount needed.

Cost

If you are inside the United Kingdom

This section explains what fee you must pay to apply if you are already in the United Kingdom under the entrepreneur category (Tier 1 Entrepreneur) of the points-based system to work in business in the United Kingdom.

The fee you must pay

You must pay £750.

Any dependant applications sent with your form are free of charge. The authority will not consider dependant applications sent separately or later without an extra fee of £395.

You must send in your fee or the authority will not consider your application.

How to fill in the payment slip

It is very important that you complete the payment slip correctly. Errors prevent the payment being processed and will delay the decision-making process.

Fill in the details of who is making the payment in case we have a payment question. If we cannot deal with the payment, the application and payment are returned to the contact name and address given in section 1.

Your fee if you withdraw your application

Once your application is received by the payment handling service, the fee is charged and cannot be refunded.

What happens if you send duplicate applications

If you send more than one application, each application will cost the standard fee.

People who are exempt from paying a fee

Nationals of the following countries do not have to pay a fee:

  • Albania;
  • Andorra;
  • Armenia;
  • Azerbaijan;
  • Croatia;
  • Georgia;
  • FYR of Macedonia;
  • Moldova;
  • Turkey; and
  • Ukraine.

If you are outside the United Kingdom

This section explains what fee you must pay if you are applying from outside the United Kingdom the entrepreneur category (Tier 1 Entrepreneur) of the points-based system to work in business in the United Kingdom.

The fee you must pay

You must pay £600, payable in the local currency.

The fee your dependants must pay

Any dependant applications accompanying your application form cost the same fee as your application, which is £600 payable in the local currency.

Once your fee has been received by the visa application centre, the fee is charged and cannot be refunded

Change of circumstances form

This section explains if you are inside the United Kingdom when you should use the change of circumstances form or the points-based system, what information you need to complete it and where you should send it.

When to use the change of circumstances form

You should use this form to notify us of any changes to your details if you are in United Kingdom. This includes:

  • Changes to an application before it has been decided;
  • Changes to an application after it has been decided;
  • The type of change, for example, to your contact details.

You must fill in the form in block capitals using a black pen. Please enter all dates as dd-mm-yyyy, for example 29-04-2000.

What information you need to complete the change of circumstances form

You will need the following information to complete the form:

  • A description of the change you want to make;
  • Your PBS reference number;
  • Your representative reference number;
  • Your date of birth;
  • Your nationality.

Sending your application

This section explains where you should send your completed application form for the entrepreneur category (Tier 1 Entrepreneur) of the points-based system to work in business in the United Kingdom.

Where to send the form if you are applying from inside the United Kingdom

Before sending us your form, you should make sure you fill in all sections that apply to your application.

Attach your cheque or postal order for the fee to page one of the application form, and send them with your supporting documents and passport(s). You can send in more documents as long as they reach us before a decision has been made.

Your application must arrive during normal business hours (0830 to 1630, Monday to Friday, excluding bank holidays), or receipt cannot be guaranteed.

If you are sending applications for your dependants at the same time as your own application, make sure all applications are sent together in one envelope so the dependant applications are considered free of charge. Dependant applications sent separately or later will have to pay a fee and we will not consider them unless you pay the right fee.

Where to send the form if you are applying from outside the United Kingdom

If you are applying from outside the UK, then you are advised to submit your form to the authority of your country's UK visa application centre (VAC).
